Examples of rent seeking in economic theory
In March 2024, two people were convicted of running a business that used dishonest and illegal methods to buy and sell tickets for popular live events such as Ed Sheeran, Lady Gaga and Little Mix concerts. Between June 2015 and December 2017, this business purchased 47 000 tickets using 127 names and 187 different e-mail addresses.
Economists refer to these actions as examples of rent seeking. However, many rent-seeking activities are not illegal.
What is rent seeking?
Rent seeking in economic theory refers to costly actions taken by people (i.e. they involve effort and expertise) to try to gain a greater share of a given level of profit /surplus. These actions do not generate any extra surplus or value for society and typically involve people trying to game or manipulate a situation or system for their own personal gain.
In many cases, the opportunity cost of these actions can be considerable. In this case, the opportunity cost is the surplus for society that could have been gained if this effort/expertise had been used to carry out more productive tasks.
A widely cited example of rent seeking is where firms exert time and effort to try to influence government policy through lobbying. Most lobbying activities in the UK are not illegal.
Non-price allocation
When prices are set below the market-clearing rate, by either the government or a private organisation, the quantity demanded of the good/service will exceed the quantity supplied. Therefore, non-price allocation must play a role. In other words, some method other than willingness to pay the price, must be used to determine which consumers receive the goods.
In some instances, such as visits to the GP or places at state schools, the good or service has a zero monetary price. In these cases. non-price allocation methods completely replace the role of the price in determining which consumers obtain the goods/services.
In other examples, a positive monetary price is set, but below the market-clearing rate. In these cases, the price partly determines who get the good/service (i.e. people must be willing to pay the non-market-clearing price), but non-price allocation also plays a role. The further below the market-clearing level the price is set, the greater the potential role for non-price methods.
Some common methods of non-price allocation include:
- First-come first served. This typically results in some type of queueing, either in person or online (a virtual queue).
- A random selection process. For example, some goods/services are allocated via a lottery, with names of consumers being randomly drawn.
- The government or other public bodies in charge of allocating the good develop a set of rules to determine which consumers/people get the good. For example, when allocating places at popular state schools, priority is often given to children who live close to the school (i.e. in the catchment area) or who live in families with certain religious beliefs.
Examples of rent seeking
When non-price methods of allocation are implemented, can consumers engage in activities that increase their chances of getting hold of the good/service? Can they manipulate the system for their own advantage and gain a greater share of any surplus? This is rent seeking.
A survey carried out in January 2025 provides some interesting evidence of rent-seeking actions taken by parents to try to secure a place for their child at a popular school. Twenty-seven per cent of the respondents admitted they had tried to manipulate the system to get their child into their preferred school. Out of those who admitted attempting to manipulate the system:
- 30 per cent registered a child at either another family member’s or friend’s address that was closer to a popular school.
- 25 per cent exaggerated religious beliefs and attended church services to try to secure a school place.
- 9 per cent temporarily rented a second home inside the catchment area for the school.
- 7 per cent moved into the catchment area for the application, only to move out once their child’s place was secured.
Some of these actions may be dishonest but are not illegal.
Rent-seeking activities in the ticketing market for live events
In the primary market for tickets, prices for popular live events are often set below market-clearing levels. Therefore, non-price methods, such as first come, first served, are used to allocate the tickets. This typically results in some type of queueing. Rent-seeking activities include actions taken by consumers to increases their chances of getting nearer to the front of the queue.
If the tickets are being sold from a physical outlet (i.e. a sales kiosk), then some consumers may start queueing many hours before the kiosk opens – in some cases camping overnight. An example is the ‘The Queue’ for Wimbledon tennis matches. Rather than queueing themselves, some people might pay others to queue on their behalf.
People who are paid to queue are sometimes referred to as a ‘line stander’, ‘queue stander’, ‘line sitter’ or ‘queue professional’. Line standers offer their services via market platforms, such as TaskRabbit.
When tickets are sold online, non-market allocation includes both queuing and random selection. Typically, people have to create an account with the primary market ticketing website (Ticketmaster, See Tickets, Eventbrite or AXS) before the sale begins. Then, using this account, they can enter an online waiting room around 15 minutes before the tickets are available to purchase. There is thus an element of first come, first served. When the sale starts, people in the waiting room are randomly allocated a place in the online queue. Once they reach the front of the online queue, the event organiser normally places limits on the number of tickets they can purchase.
What can people do to manipulate this system and so increase their chances of purchasing tickets? In other words, what are the possible rent-seeking activities? One possibility is to create multiple accounts using the details of friends/family and then join the waiting room with each of these accounts using separate devices. Professional resellers often try to use specialist software, called bots, that can create thousands of fake accounts and so significantly increase the chances of getting to the front of the queue. Once they get to the front of the queue, an account created by a bot can proceed through the purchasing process much faster than a person can. The tickets can then be sold for a profit in the uncapped secondary market via websites such as Stubhub and Viagogo.
The UK government passed a law in 2017 that made the use of bots to circumvent ticket purchase limits an illegal activity. The use of ticket bots in the EU became illegal in 2022. Primary market ticketing websites have also invested in technology that tries to detect and block the use of this type of software.
Government policy in the resale of tickets
Should the government prohibit the resale of tickets or implement a resale price cap to try to deter this rent-seeking activity?
Many economists would oppose this policy because of the benefits of the secondary market. For example, resale helps to reallocate tickets to those consumers with the highest willingness to pay. Therefore, the secondary-ticketing market can have a positive impact on allocative efficiency, but it comes at a cost – rent-seeking activities.
Research by economists published more than ten years ago found that the positive impact of the resale market on allocative efficiency outweighed the rent-seeking costs. However, developments in technology have increased the level of rent seeking in recent years, making it easier and less costly for professional resellers to purchase large amounts of tickets in the primary market. Therefore, it is possible that the rent-seeking cost of the secondary market now exceeds its positive impact on allocative efficiency. A case can thus be made for greater intervention by the government.
Recent accusations have also been made about possible rent-seeking activities by sellers in the primary ticketing market too, adding to concerns.

Tickets for Beyonce’s 2023 UK Renaissance tour went on general sale via Ticketmaster’s website at 10am on Tuesday 7 February. Throughout the day, social media were full of messages from fans complaining about technical issues, long online queues and rising prices. This is not the first time this has happened. Similar complaints were made in 2022 when tickets went on sale for tours by Bruce Springsteen, Harry Styles and Taylor Swift.
With the general sale of tickets for Beyonce’s tour, many fans complained they were waiting in online queues of over 500 000 people. Others reported their frustration with continually receiving ‘403 error’ messages.
Market dominance
In November 2022, Ticketmaster’s website in the USA constantly crashed during the pre-sale of tickets for Taylor Swift’s tour. This led to the general sale of tickets being cancelled.
In response to the public anger that followed this decision, the Senate’s antitrust subcommittee organised a hearing with the title – ‘That’s The Ticket: Promoting Competition and Protecting Competition and Protecting Consumers in Live Entertainment.’
Senator Amy Klobuchar, the Chair of this committee, stated that
The issues within America’s ticketing industry were made painfully obvious when Ticketmaster’s website failed hundreds of thousands of fans hoping to purchase tickets for Taylor Swift’s new tour, but these problems are not new. For too long, consumers have faced long waits and website failures, and Ticketmaster’s dominant market position means the company faces inadequate pressure to innovate and improve.
Ticketmaster merged with Live Nation in 2010 to become the largest business in the primary ticket market for live music events. Some people have accused the firm of abusing its dominant market position by failing to invest enough money in its website, so leading to poor customer service.
Dynamic pricing
Fans have also been complaining about the system of dynamic pricing that Ticketmaster now uses for big live events. What exactly is dynamic pricing?
Firms with market power often adjust their prices in response to changing market conditions. For example, if a business experiences significant increases in demand for its products in one quarter/year it may respond by raising prices in the following quarter/year.
With dynamic pricing, these price changes take place over much shorter time periods: i.e. within minutes. For example, in one media report, a Harry Styles fan placed £155 tickets in their basket for a concert at Wembley stadium. When the same fan then tried to purchase the tickets, Ticketmaster’s website sent a message stating that they were no longer available. However, in reality they were still available but for £386 – the price had instantly jumped because of high demand. Continually monitoring market conditions and responding to changes so quickly requires the use of specialist software and sophisticated algorithms.
Arguments for dynamic pricing
With ticket sales taking place months/years in advance of most live events, it is difficult for artists/promotors to predict future levels of demand. Given this uncertainty and the importance for the artist of playing in front of a full venue, event organisers may err on the side of caution when pricing tickets.
If the demand for tickets proves to be much stronger than initially forecast, then resellers in the secondary market can take advantage of the situation and make significant amounts of money. Dynamic pricing enables sellers in the primary market, such as Ticketmaster, to adjust to market conditions and so limits the opportunities of resale for a profit.
Ticketmaster argues that without dynamic pricing, artists will miss out on large amounts of revenue that will go to re-sellers instead. A spokesperson for the company stated that
Over the past few years, artists have lost money to resellers who have no investment in the event going well. As such event organisers have looked to market-based pricing to recapture that lost revenue.
Critics have claimed that Ticketmaster’s use of dynamic pricing is simply an example of price gouging.
No doubt the controversy over the sale of tickets for live music events will continue in the future.

The UK Parliament’s Culture Media and Sport Select Committee has been examining the secondary ticketing market. The secondary market for events is dominated by four agencies – viagogo, eBay-owned StubHub and Ticket-master’s Get Me In! and Seatwave. These buy tickets to events in the primary market (i.e. from the events or their agents) and then resell them, normally at considerably inflated prices to people unable to get tickets in the primary market.
One example has grabbed the headlines recently. This is where viagogo was advertising tickets for an Ed Sheeran charity concert for £5000. The original tickets were sold for between £40 and £110, with the money going to the Teenage Cancer Trust. None of viagogo’s profits would go to the charity. The tickets were marked ‘not for resale’; so there was doubt that anyone buying a ticket from viagogo would even be able to get into the concert!
There are four major issues.
The first is that the tickets are often sold, as in the case of the Ed Sheeran concert, at many times their face value. We examined this issue back in September 2016 in the blog What the market will bear? Secondary markets and ticket touts).
The second is that the secondary sites use ‘bots’ to buy tickets in bulk when they first come on sale. This makes it much harder for customers to buy tickets on the primary site. Often all the tickets are sold within seconds of coming on sale.
The third is whether the tickets sold on the secondary market are legitimate. Some, like the Ed Sheeran tickets, are marked ‘not for resale’; some are paperless and yet the secondary ticket agencies are accused of selling paper versions, which are worthless.
The fourth is that multiple seats that are listed together are not always located together and so people attending with friends or partners may be forced to sit separately.
These are the issues that were addressed by the Culture Media and Sport committee at its meeting on 21 March. It was due to take evidence from various people, including viagogo, the agency which has come in for the most criticism. Viagogo, however, decided not to attend. This has drawn withering criticism from the press and on social media. One of the other witnesses at the meeting, Keith Kenny, sales and ticketing director for the West End musical Hamilton, described viagogo as ‘a blot on the landscape’. He said, ‘Ultimately, our terms and conditions say ticket reselling is forbidden. If you look at the way that glossy, sneaky site is constructed, they’ve gone an awful long way not to be compliant in the way they’ve built their site.’
The Competition and Markets Authority launched an enforcement investigation last December into suspected breaches of consumer protection law in the online secondary tickets market. This follows on from an earlier report for the government by an independent review chaired by Professor Waterson.
The government itself is considering amending the Digital Economy Bill to make it illegal to use bots to buy tickets in excess of the limit set by the event. Online touts who break this new law would face unlimited fines.

If you want a ticket for an event, such as a match or a concert, but the tickets are sold out, what do you do? Many will go to an agency operating in the ‘secondary market’. A secondary market is where items originally purchased new, such as tickets, company shares, cars or antiques, are put up for sale at a price that the market will bear.
The equilibrium price in a secondary market is where supply equals demand and the actual price will approximate to this equilibrium. In the case of tickets, this equilibrium price can be much higher than the original price sold by the venue or its agents. The reason is that the original price is below the equilibrium.
This is illustrated in the figure (click here for a PowerPoint). Assume that the total supply of tickets is Qs. Assume also that the official box office price is Pbo
and that demand is given by the demand curve D. At the box office price demand exceeds supply by Qd – Qs. There is thus a shortage, with many fans unable to obtain a ticket at the official price. Many of you will be familiar with having to be as quick as possible to get hold of tickets where demand considerably outstrips supply. Events such as Glastonbury sell out within seconds of coming on sale.
If you buy a ticket and then find out you cannot go to the event, you can sell the ticket on the secondary market through an online site or agency. Such agencies could be seen as providing a useful service as it means that otherwise empty seats will be filled. But if the equilibrium price is well above the original ticket price, there is the potential for huge gain by the agencies, who may pay the seller considerably less than the agency then sells the ticket to someone else.
What is more, the difference between the original price and the equilibrium price in the secondary market makes ticket touting, or ticket ‘scalping’, highly profitable. This is where people buy tickets with no intention of using them themselves but in order to sell them at much higher prices on the secondary market. Such ticket touting has been illegal for football matches since 1994 and was illegal for the 2012 London Olympics, but it is legal for plays, concerts, festivals and other events.
Ticket touts are often highly organised in obtaining tickets at official prices by buying early and using multiple credit cards and multiple identities to avoid systems that restrict the number of tickets issued to a card. They often use internet bots to mass purchase tickets the moment they go on sale.

Those in favour of ticket touting argue that the high price in the secondary market is just a reflection of demand and supply (see the IEA article below). Ticket touting allows tickets to be directed to people who value them most and will get the greatest benefit from it. What is more, banning ticket touting, so the argument goes, would simply drive it underground.
Those against argue on grounds of equity. Ticket prices set below the equilibrium are designed to give greater equality of access to fans. Rationing on a first-come first-served system, either on the internet or by a queue, is seen to be fairer than one by ability/willingness to pay. A poor person may be just as keen to go to an event as a rich person and gain just as much enjoyment from it, but cannot afford the high equilibrium price. What is more, non of the profit from the higher prices reaches the event organisers or the artists or players. Yet the mark-up and hence profit made by ticket touts can be massive, as the first Observer article below shows.
Various measures are being tried to prevent ticket touting. One is the use of paperless tickets, with the number of tickets limited per person and with people having to show their ticket on their phones along with ID at the door or gate. If a person cannot attend, then the solution is a system where they can give the ticket back to the box office (perhaps electronically) which will re-sell it for them at the official price.
A government-backed investigation, the Waterson review reported in May 2016 and recommended that touts should be licensed and that there should be harsher penalties for firms that flout consumer rights law as applying to ticket sales. Whether this would be sufficient to bring secondary market prices down significantly, remains to be seen. In the meantime, organisers do seem to be trying to find ways of beating the touts through smarter means of selling.
